Cancellation and Returns Policy

Preamble

Our trading name is: Amelia Jane London; the website at: <www.ameliajanelondon.com> (“Our Site, Site, Website); and the domain name:  ameliajanelondon.com (“We”) all belong to Amelia Jane London Ltd. Amelia Jane London Ltd is a Company incorporated in the United Kingdom under Company Number: 08969652. The registered office address of Amelia Jane London Ltd is 20-22 Wenlock Road, London N1 7GU. Please note that this is NOT our returns address, nor is it a retail premises, it is purely our registered office address.

Amelia Jane London is a clothing and lifestyle brand that offers high quality hats and accessories for sale through the Site (the “Service”). Subscription to the Site is free.

By using the Service you agree to be bound by an agreement with us, which incorporates this Cancellation and Returns Policy known as the Amelia Jane London User Service Agreement. If you do not accept this Cancellation and Returns Policy, please discontinue use of our Service immediately.

Cancellation and Returns Policy

Since June 2014, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the “Regulations”) apply to all purchases via a website. We shall use the Regulations as the benchmark for our cancellation and returns policy. Schedule 3 of the Regulations set out the Model Instructions for exercising the Right to Cancel within the European Union. The Model Instructions can be found here www.legislation.gov.uk/uksi/2013/3134/schedule/3/made. 

Cancellation

The Regulations state that your right to cancel an order starts the moment you place your order and doesn’t end until fourteen working days from the day after you receive your goods. In the circumstance where you have not received your goods and you cancel, your payment will be refunded immediately and you should allow 3 working days to receive the payment.

Cancellation in these circumstances can be made by sending an email titled “Cancellation Request” to returns@ameliajanelondon.com.

Returns and Exchanges

In the circumstance where you have already received your order and wish to return your purchase this process is governed by the following rules in line with our returns policy:

1.  A refund will not be issued for fraud returns as explained in our general terms and conditions.

2.  All refunds exclude the postage cost of the original order placed via the Service.

3.  A postage fee of £4 will be required in case of an exchange of your returned goods, on the replacement item/s.

4.  It is advised that you use a secure, tracked method of posting to ensure returns reach us, and keep your receipt as proof of postage.

You may cancel a transaction via the Service and we shall issue you with a refund of the purchased item if you cancel within fourteen working days of payment, provided you have not damaged, worn, washed and/or altered items purchased via the Service. In the specific instance where you haven’t damaged, worn, washed and/or altered items purchased via the Service, we will issue a refund within 30 days of your cancellation request.

Returns should be sent back to our returns address, with the Amelia Jane London returns form enclosed in the package.  For a copy of our returns form, which gives further instructions including our returns address, please email returns@ameliajanelondon.com with the subject header “Return Request.”

Jurisdiction

The Parties expressly and irrevocably agree that this Cancellation and Returns Policy and the relationship of the Parties shall be governed by and construed solely in accordance with English law. In addition, the Parties expressly and irrevocably agree that any dispute, suit, action or proceedings, which may arise out of, or in connection with, this Cancellation and Returns Policy shall be submitted to the English courts.
